Terms of Service
These Terms of Service ("Terms") govern your access to and use of the BeatZ FM Radio mobile application (the "App"), operated by BeatZ FM Radio LLC ("BeatZ FM," "we," "us," or "our"), a company organized under the laws of the State of Texas, USA. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of Service
BeatZ FM Radio is an internet-based FM radio streaming application that allows users to listen to live and on-demand audio content. Certain features, including exclusive content and promotional offers/deals, require account registration.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or legal guardian.
3. Accounts
3.1 Browsing Without an Account
You may access core streaming features of the App without registering an account.
3.2 Account Registration
To access member-only content or offers, you must register using your email address and phone number. You agree to:
- Provide accurate and complete information
- Keep your login credentials confidential
- Notify us promptly of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Offers and Deals
From time to time, the App may display offers, coupons, or deals from BeatZ FM or third-party partners. These offers:
- Do not involve any in-app purchases or payments through the App
- Are subject to their own terms and availability, as set by the issuing partner
- May be modified, discontinued, or withdrawn at any time without notice
BeatZ FM is not responsible for the fulfillment of third-party offers and makes no warranties regarding their accuracy or availability.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to the App, our servers, or any connected systems
- Interfere with or disrupt the App's functionality, including through malware, bots, or scraping
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law
- Rebroadcast, resell, or redistribute streamed content without our express written permission
- Impersonate any person or entity, or misrepresent your affiliation
6. Intellectual Property
The App, including its design, logos, trademarks, software, and all streamed audio content (unless otherwise credited), is owned by or licensed to BeatZ FM Radio LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.
7. Third-Party Services
The App uses Firebase Cloud Messaging (provided by Google) to deliver push notifications. Your use of the App is also subject to Google's applicable terms and privacy practices with respect to this service. See our Privacy Policy for more information.
8. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO THE APP, AS STREAMING QUALITY MAY DEPEND ON YOUR INTERNET CONNECTION AND OTHER FACTORS BEYOND OUR CONTROL.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEATZ FM RADIO LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
10. Termination
We may suspend or terminate your access to the App, with or without notice, if you violate these Terms or engage in conduct we believe is harmful to the App, other users, or third parties. You may stop using the App and delete your account at any time.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas.
